THE CONTRACT
The person who signs the booking form does so on behalf of all the individuals included on it, and all are bound by these booking conditions. They accept these conditions on behalf of herself or himself and all other named persons on the Booking Form and acknowledges that she or he is authorised to accept these conditions on behalf of those they are booking for.
All persons named on the Booking Form, are hereafter referred to as "you". All bookings are made with Nature and Nosh Tours NZ Limited (trading as The Bush Boardroom), hereafter referred to as the "company", "we" or "us". No variation of these conditions may be made unless this is done in writing by a director of the company.
This contract represents your entire agreement with us. You agree that this contract does not transfer any rights or legal redress to a third party, except you as a participant. If any part of this contract is deemed invalid or impossible to implement according to the law, that part shall be composed according to the law in a way that expresses the intent of the parties in the best possible manner, while the rest of the contract shall remain valid.
RISK & EXCLUSION OF LIABILITY
There is an element of risk involved with any adventure activity. Risks in undertaking our activities include (but are not limited to): hypothermia, heat exhaustion, physical injury caused by environment i.e. rock falls, and physical injury caused by self i.e. falling over.
The staff, contractors and management of Nature and Nosh Tours NZ Limited take all practicable steps to identify and minimise potential dangers.
In participating in our tours, you agree to the following conditions:
- I agree that I must follow the instructions of the Bush Boardroom staff at all times; furthermore, I agree that if I am the adult accompanying any person under the age of 18 I must ensure that the underage person follows our instructions at all times;
- My successors, executors and administrators are bound by the Booking Terms & Conditions.
- I agree not to commence any litigation proceedings in any country in relation to the risks and liabilities set out above and to indemnify Nature and Nosh Tours NZ Ltd against any claims;
- I confirm I am physically fit and have no medical conditions which could affect my ability to participate in any aspect of our tours;
- I consent to receive medical treatment in the case of injury, accident or illness during the activity and to indemnify Nosh Tours NZ Limited against any claims, costs or expenses in respect of the treatment
PAYMENT
All prices quoted for The Bush Boardroom are in New Zealand Dollars (NZD) unless otherwise stated. All prices are EXCLUSIVE of 15% New Zealand Goods and Services Tax (GST).
All bookings for packages require a 50% deposit to secure. The final balance is due 14 days before the booked date. Any decreases to numbers after this time will still be charged at the full rate. Any additions to this number will be subject to availability and confirmation.
CANCELLATIONS & REFUNDS
All cancellations must be made in writing and emailed to
kylie@bushboardroom.co.nz (effective from the sent date on the email). You are advised to call us directly if you have not received an acknowledgement that your cancellation notice has been received by us within 48 hours of sending.
Cancellation charges are as follows:
More than 14 days out, $150 cancellation fee.
Between than 14 and 7 days out, no refund, but fully transferrable to
another date subject to availability.
Within 6 days of the scheduled date, 20% charge, 80% transferrable to
another date subject to availability.
PROGRAMME CHANGES
Due to operating a significant proportion of our packages outdoors, there are elements beyond our control. We will do our best to deliver the experience outlined in each package. However, from time to time, there are factors and circumstances which may cause us and/or your hosts to alter or change the tour. We will notify you as soon as possible of any changes necessary and all packages will proceed with adjusted itineraries. This includes walking tracks, workshops, etc. We will inform you of any changes as soon as we are aware of them.
SPECIAL DIETARY REQUIREMENTS
We celebrate the diversity that is all things nature, this includes people. If you have any special dietary requirements , allergies or preference, we need to be informed at the time of booking. This is so we can plan and prepare to meet your needs. We hope to accommodate all special dietary requirements, however, if this is not possible we will inform you as soon as possible.
HEALTH & MEDICAL
We ask that each individual completes a risk and medical disclosure form before participating in our packages.
Our facilitators have the right to disqualify anyone, at any time, during the experience if he or she feels the individual is physically incapable and/or if an individuals continued participation will compromise the safety or be detrimental to the individual involved or the group. Refunds are not given under such circumstances. If you are feeling unwell during the experience, you agree that you will let the host know immediately and will not participate in any activities whilst you are feeling unwell.
USE OF IMAGERY
Nature and Nosh Tours NZ Ltd (trading as The Bush Boardroom) reserves the right to use any photographic images or video of guests for promotion purposes. This may include but is not limited to images used online, in printed material or events.
CHANGES TO BOOKING TERMS & CONDITIONS
The company reserves the right to change the terms and conditions at any time without notification. All packages will be subject to the terms and conditions at the time of booking. As such, it is a requirement to read the full terms and conditions prior to completing the booking.
GOVERNING LAW
This website and all component parts, including these Booking Terms and Conditions are governed by the laws of New Zealand and you agree to submit to the exclusive jurisdiction of the Courts of New Zealand.
